What kind of claims are allowed for my product?
Health claims (optional) are a type of nutrition claim (e.g. a healthy diet low in saturated and trans fats may reduce the risk of heart disease) and are government regulated. The approved nutrition claim may highlight a nutritional feature of a food or a relationship between diet and disease.
Product claims (optional) are not subject to nutritional claim regulations above. (e.g. Vegan, 3g of Sugar per Serving, Non-GMO) as long as you have the substantiation on hand.
How are the regulations enforced in Canada?
Regulations are enforced by the Canadian Food Inspection Agency. They respond to enquiries related to compliance and enforcement activities
How are the regulations enforced in USA?
To protect public health, FDA monitors firms and the foods that they produce through inspection and sampling. Non-compliance could result in voluntary destruction, withdrawals, recalls, seizures, injunctions and criminal prosecution.
